1. Platform Overview
TeQatlas GmbH provides a B2B platform where users can create personal and company profiles, connect with other businesses and professionals, and utilize various tools for information gathering and networking.
Account Creation: Users must provide a company email, which will be confirmed via a 2-factor authentication (2FA) code sent to the email. Based on the company email, TeQatlas automatically retrieves company information from public sources such as LinkedIn and the company’s website. This data is then used to populate a company profile with the assistance of GPT-based technology. A user profile is also automatically generated, requiring the user to provide their first name, last name, and position within the company. Users can update or request modification of this information through their account settings.
Information Available:
Company Information: Users can access details such as the company website, contacts, employees, services and products offered, and other publicly available information.
User Information: Users can access other users’ profiles, which may include contact details like phone numbers, emails, and social media links.
Platform Features:
Users can leverage a copilot feature to search and generate information.
The platform allows users to send verification requests to companies and connection requests to other users, similar to LinkedIn.
Users can also engage in direct messaging and chat within the platform.
Data Collection Disclosure: Collected data is used for optimizing user experience through AI-driven features. All data usage complies with applicable privacy regulations, and users can manage their data through their account settings.
2. User Responsibilities
User Conduct
Users of TeQatlas are expected to adhere to the following best practices to maintain a professional and secure environment:
Compliance with Laws: Users must comply with all applicable laws and regulations while using the platform.
Accurate Information: Users are responsible for ensuring that the information they provide is accurate and up-to-date.
Prohibited Activities: Users must not engage in activities such as spamming, harassment, distribution of malware, or any other illegal or unethical behavior.
Respect for Privacy: Users must not misuse the contact information or personal data of other users obtained through the platform.
Intellectual Property: Users may not replicate, distribute, or use any part of TeQatlas’ proprietary content without prior permission. Users can report potential IP violations via our designated IP infringement form or via customer support.
Data Privacy Details: Users are prohibited from collecting or using personal data of other users for unsolicited marketing or any purposes outside of the platform's intended use.
3. Payment Terms
Subscription and Payment Model
TeQatlas is currently offered as a free service. However, in the future, subscription plans will be introduced. Upon the introduction of subscription plans, users will be notified in advance. Failure to transition to a paid plan may result in restricted access to premium features. TeQatlas reserves the right to modify subscription plans, pricing, and features at its discretion.
4. Delivery of Services
Service Availability
TeQatlas strives to maintain high availability of its platform but does not guarantee uninterrupted access. The platform may be unavailable at times due to scheduled maintenance, updates, or unforeseen technical issues. TeQatlas will make reasonable efforts to notify users of planned downtime but reserves the right to make changes to the service without prior notice.
5. Termination of Service
Termination Conditions
User-Initiated Termination: Users may request the deletion of their account by contacting TeQatlas support at support@teqatlas.com.
TeQatlas-Initiated Termination: TeQatlas reserves the right to terminate a user’s account without notice if the user violates these Terms and Conditions or engages in activities deemed harmful to the platform or other users.
Clarify Data After Termination: Upon termination, TeQatlas will delete all user data within 30 days unless otherwise required by law.
Grievance Procedure: Users may contest account termination by submitting a request to support@teqatlas.com within 14 days of termination.
6. Limitations of Liability
TeQatlas GmbH provides the platform "as is" and "as available" without warranties of any kind, either express or implied. Users agree that:
No Warranty of Data Integrity: TeQatlas does not guarantee the accuracy, completeness, or reliability of any information or data provided through the platform. Users acknowledge that the platform may be subject to errors, interruptions, or data loss, and TeQatlas is not liable for any such occurrences.
Limitation of Liability: In no event shall TeQatlas be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising out of the use or inability to use the platform.
Maximum Liability: The total liability of TeQatlas for any claim arising from the use of the platform shall not exceed the amount paid by the user for the service in the six months preceding the claim.
Further Explain Liability Limits: TeQatlas will not be held liable for damages resulting from third-party services integrated into the platform or unauthorized access to user accounts.
7. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law principles. However, TeQatlas may also comply with local laws applicable to its users in other jurisdictions, particularly within the European Union and the United States. TeQatlas complies with the General Data Protection Regulation (GDPR) for EU users and the California Consumer Privacy Act (CCPA) for US users. Any disputes arising out of or related to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in Zurich, Switzerland.
8. Dispute Resolution
In the event of a dispute between the user and TeQatlas:
Negotiation and Mediation: The parties agree to first attempt to resolve the dispute informally through negotiation. If the dispute cannot be resolved through negotiation, the parties will consider mediation as a next step.
Arbitration: If mediation is unsuccessful, the dispute may be submitted to binding arbitration under the rules of the International Chamber of Commerce (ICC). The arbitration shall take place in Zurich, Switzerland, and the language of arbitration shall be English.
Online Dispute Resolution: If negotiation and mediation are unsuccessful, parties may submit the dispute for online arbitration.
Court Action: If arbitration is not applicable or enforceable, disputes shall be resolved in the courts of Zurich, Switzerland.
9. Intellectual Property
Ownership of Content
TeQatlas GmbH retains all rights, title, and interest in and to the platform, including but not limited to the software, databases, designs, algorithms, and content generated or provided by the platform. Users acknowledge that:
Content Submission: User-generated content remains the property of the user. By uploading content, the user grants TeQatlas a non-exclusive, royalty-free license for use within the platform.
Proprietary Rights: Users are prohibited from copying, modifying, distributing, or using any part of the platform or its content without the express written permission of TeQatlas.
Intellectual Property Infringement: TeQatlas will take appropriate legal action against users or third parties who infringe upon its intellectual property rights.
